Terms & Conditions

Payments 

All items are custom made to fit each client, therefore, prices are quoted individually. The total price payable is the price on the Invoice. An order is considered for processing when the signed contract and initial 50% nonrefundable retainer fee is received.  Dates are not reserved until the full deposit amount is paid. The remaining balance is due 7 days before the event date. We reserve the right to cancel your order without issuing a refund if the final deposit is not made by the due date. Orders placed 14 days or less in advance of the event date must be paid in full at the time of booking.  Orders placed less than 14 days in advance are subject to a $30.00 rush fee.  We only accept PayPal payments at this time which is payable via the invoice.  The customer does not need a PayPal account to make payments

All sent invoices are only valid for 2 business days and will be voided if payment has not been made to secure the event date within the allotted 2 days.  A new quote may be higher than the previous quote if the customer choses to continue with placing the order.

 

The final payment date is also the final date for any changes of size, style or flavor of the cake. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

Cancellations

The 50% retainer fee confirms the reservation on our calendar for the week(s) leading up to the event date. It further allows  the purchase of supplies necessary for the order. Event orders for any date are limited to ensure a high standard can be maintained on every order taken. Order cancelation must be done in writing as soon as possible, however, the 50% retainer is non-refundable with no exception.  We will refund any additional payments, made beyond the 50% non-refundable retainer, on the condition that your cancellation is received 10 days in advance of the event date. No refunds will be issued for cancellations notification 10 days or less prior to the event date. This is due to preparation work and purchased supplies. 

Delivery & Setup

Delivery and setup are required for all multi-tiered wedding and custom cakes. Tiered cakes are fragile by nature and Royal Cakes & Treats is not in a position to make repairs to damaged cakes after the client has take possession. A delivery fee apply to all events outside of Buford. Applicable parking charges will be added to your invoice and payable in advance. The client is responsible for checking with the venue for any restrictions which may apply to the delivery and/or setup of their cake or dessert table. The client is responsible for ensuring there is an appropriate and secure table at the event location as cakes can be heavy. Royal Cakes & Treats is not liable if the venue prevents setup of any element of the client's order. It is the client's responsibility to partner with the venue and decorator/florist for tables, tablecloths, decoration and for the cutting and service of the cake unless otherwise expressly agreed upon with Royal Cakes & Treats. Royal Cakes & Treats offers cutting and service of the cake for the client's guests for an agreed upon additional fee. 

 

Pick-ups

The client assumes all liability and responsibility if  Royal Cakes & Treats is not scheduled to deliver your cake.  Royal Cakes & Treats will advise on how to safely secure the cake in the vehicle of choice and cautions not to leave the cake in the vehicle to run errands.  


Cake Care

Royal Cakes & Treats is not responsible for any damages caused to the cake after setup is complete. Cake cutting instructions will be provided and a list of all internal structure (dowels, boards, etc.) to be removed before serving. It is the responsibility of the client to adhere to the cake cutting and serving instructions to ensure correct servings are obtained. If flowers are provided by an outside source, you acknowledge that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. All cakes require an optimal room temperature of 70 degrees or below. Outdoor events or rooms with temperatures higher than 70 degrees will adversely affect the cake. The client assumes all liability for cakes that melt, collapse, or lean if displayed in temperatures higher than 70 degrees. We advise clients to keep cakes in an air-conditioned environment or in a refrigerator until their event begins. 


Our Liability

Royal Cakes & Treats cannot be held liable for any failure to perform or delay in performance of any of our obligations  that is caused by adverse weather, highway hazards, road incident, any  act of nature or event beyond our reasonable control. Royal Cakes & Treats will always make the best endeavor1 to deliver according to the contract insofar as it does not expose the company and its agents to risk of harm, injury or death. 

In the very unlikely event that Royal Cakes & Treats is unable to deliver in accordance with the contract then the company will make every attempt to secure an alternative Cake Designer of comparable standard who is willing to perform this contract at the rate paid by the Client. The sums agreed to and paid under the contract, and as detailed on the Invoice, will have liability limited to this reimbursed amount to the client in the event that no replacement can be secured. Royal Cakes & Treats cannot be held liable  for emotional, physical or financial distress due to any unforeseen circumstances.
